Attention, Amazon sellers with sales in the European Union: The Extended Producer Responsibility (EPR) requirements under the EU Battery Regulation will take effect on August 18, 2025. According to this regulation, you must register in each EU country/region where you are considered a producer and provide your registration number to Amazon.

Will Amazon Sellers Be Affected?

 

You are considered a producer if you meet at least one of the following conditions:

1. Your company is established in another EU Member State (not the country of sale) or a third country (non-EU)

• Selling batteries or products containing batteries directly to end-users in an EU Member State through remote contracts (or online sales).

  

2. Your company is established in an EU Member State:

• First manufactures and supplies batteries or products containing batteries within that country under your company name or trademark.
• Resells batteries or products containing batteries under your company name or trademark (when no manufacturer’s name or trademark is present on the battery).
• First supplies batteries or products containing batteries from other EU Member States or third countries in a professional capacity (e.g., as an importer).

What Actions Should Amazon Sellers Take?

 

Step 1:If you are considered a producer, register in each relevant EU Member State. Refer to the table below for the Extended Producer Responsibility requirements specific to each country/region.

Special Note for Amazon Chinese Sellers:

According to the EU Battery Regulation, if you are a producer not established in the country of sale, you must appoint an Authorized Representative (AR) established in the country of sale and register through them. However, the specific implementation details of the Extended Producer Responsibility requirements by EU Member States have yet to be fully outlined. Therefore, Amazon recommends consulting with your professional advisors or agencies to confirm whether the EU Battery Regulation applies to you and to receive guidance on the registration process for Authorized Representatives in relevant countries.

 

Step 2:Submit your corresponding registration numbers for each EU Member State through the compliance portal (if you have completed registration) to demonstrate compliance to Amazon. The relevant portal will be launched in Q4 2024, at which point Amazon will notify you via email.

 

Step 3:Annually report your battery sales to the relevant EU authorities or Producer Responsibility Organizations and pay the associated eco-fees.

 

Helpful Tip:Between Q3 and Q4 of 2024, Amazon will inform you of the specific battery-related requirements under the Extended Producer Responsibility from certain EU Member States (once confirmed by those countries) and provide instructions on how to submit your registration numbers and pay the eco-fees related to battery sales.

What Are the Consequences of Failing to Demonstrate Compliance?

 

To prove compliance, you must provide Amazon with your producer registration numbers for each EU Member State via the compliance portal by August 18, 2025. This portal will go live in Q4 2024, and Amazon will notify you via email.

 

If you are found non-compliant, depending on the country/region, Amazon may need to halt the sale of your non-compliant products or comply on your behalf through a paid service.

 

Once EU countries/regions introduce their respective national Extended Producer Responsibility battery compliance requirements in 2024, Amazon will send you further communication.
